Terms of Use

This is a starting-point draft, written to cover the basics (liability for user-generated content, usage restrictions, no refunds for output dissatisfaction) — it is not legal advice, and it hasn't been reviewed by a lawyer. Have one look it over, especially the liability, indemnification, and governing-law sections, before this is relied on for real.

These Terms of Use ("Terms") govern your access to and use of Scenetimental, a self-hosted AI image, video, and audio generation service operated by Differson LLC ("Scenetimental," "we," "us"). By creating an account or using the service, you agree to these Terms.

1. Eligibility

You must be at least 18 years old to create an account. By signing up, you represent that you meet this requirement.

2. Accounts

You're responsible for the accuracy of the email address on your account and for any activity that happens under it. Sign-in is passwordless (email link) - keep access to your email account secure, since anyone with access to it can access your Scenetimental account.

3. Subscriptions, Credits & Billing

  • Paid plans are billed monthly and renew automatically until cancelled.
  • You can cancel anytime; you keep access through the end of the current billing period.
  • Credits included in your plan reset each billing cycle and do not roll over.
  • All sales are final. We do not issue refunds because you're unhappy with how a generation turned out — AI generation is inherently variable, and dissatisfaction with output quality, style, or content is not grounds for a refund. Refunds are considered only where required by law or in cases of a verified billing error on our part.
  • Credits are only deducted for generations that complete successfully. Requests blocked by the safety filter or that fail due to a system error are not charged.

4. Acceptable Use

You agree not to use the service to generate, and not to attempt to bypass filters in order to generate:

  • Content depicting or referencing real, identifiable people without their consent;
  • Nudity or sexually explicit content;
  • Graphic gore, self-harm, or other extreme violent content;
  • Content depicting illegal activity (e.g. drug manufacturing, weapons instructions, exploitation of minors);
  • Content that infringes another party's intellectual property or rights of publicity.

Stylized action/game-style violence (weapons, combat, action poses) as concept art is permitted. We use automated filtering on both prompts and generated output — filtering can be imperfect in both directions, and we may update it over time.

Violating this section may result in a warning, temporary suspension, or permanent termination of your account at our discretion, without refund of any remaining credits or subscription fees.

5. Your Content & Responsibility

You retain ownership of the images, video, and audio you generate through the service, subject to your compliance with these Terms and applicable law.

You are solely responsible for the prompts you submit and the content you generate. We do not review every generation before it reaches you, and we make no claim that any output is free of third-party rights. If you generate content that infringes someone else's copyright, trademark, likeness, or other rights, that is your responsibility, not ours - you agree to indemnify and hold Differson LLC harmless from any claim, loss, or damages arising from your use of generated content, including third-party IP infringement claims.

6. Underlying Models & Licensing

The service is built on commercially-licensed third-party model weights (including OpenRAIL++ and Apache 2.0 licensed models). We make reasonable efforts to keep the underlying models commercially usable, but licensing terms for third-party models can change, and we're not liable for changes made upstream by those model providers.

7. Service Availability

The service runs on third-party cloud GPU infrastructure and may be unavailable due to maintenance, provider outages, or high demand. We don't guarantee uninterrupted availability.

8. Disclaimer of Warranties

The service is provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or non-infringement.

9. Limitation of Liability

To the maximum extent permitted by law, Differson LLC's total liability for any claim arising from your use of the service is limited to the amount you paid us in the 3 months before the claim arose. We are not liable for indirect, incidental, or consequential damages.

10. Termination

We may suspend or terminate your account for violation of these Terms, non-payment, or suspected fraudulent/abusive use. You may stop using the service and cancel your subscription at any time.

11. Changes to These Terms

We may update these Terms from time to time. Continued use of the service after an update means you accept the revised Terms.

12. Governing Law

These Terms are governed by the laws of [jurisdiction to be confirmed], without regard to conflict-of-law principles.
